To the fullest extent permitted by law, MedTrainer, its officers, directors, employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to:

  • Loss of profits or revenue,
  • Loss of data,
  • Business interruption,
  • Direct, indirect, incidental, or consequential damages, including lost profits, data loss, business interruptions, or reputational damage,
  • Service delays, failures, or disruptions caused by uncontrollable events, such as natural disasters or network failures
    Any other tangible or intangible loss arising from your use of, or inability to use, the Service or the AI technology

Specifically, MedTrainer is not liable for:

  • Errors or inaccuracies in any offered Service,
  • Unauthorized access to or alteration of your data or transmissions,
  • Any delays, failures, or disruptions in the Service caused by events beyond our reasonable control, such as natural disasters, network failures, or acts of third parties.

In no event shall MedTrainer’s total liability for any claims related to the Service exceed the greater of (1) $25,000 and (2) three months of service paid by you to MedTrainer in the six (6) months prior to the occurrence giving rise to the liability.

7. Intellectual Property

7.1 Ownership

All intellectual property rights in the Service, including but not limited to the underlying software, algorithms, AI models, trademarks, logos, and designs (the “Intellectual Property”), are and shall remain the sole and exclusive property of MedTrainer or its licensors. You are granted no ownership rights or any implied licenses to the Intellectual Property, except for the limited, revocable right to use the Service as set forth in these Terms.
You may not:

  • Copy, distribute, modify, or create derivative works of the Service or its Intellectual Property.
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to access the source code of the software or AI technology.
  • Use any of our trademarks, service marks, or logos without our express written permission.

7.2 User-Generated Content

Any data, documents, or content uploaded by you (the “User Content”) to the Service remains your property. However, by uploading User Content, you grant MedTrainer a non-exclusive, worldwide, royalty-free, license to use, process, and store such User Content solely to provide the Service to you.

You warrant that you have the necessary rights to upload the User Content and that it does not violate any third-party intellectual property rights. You agree to indemnify MedTrainer against any claims arising from your violation of intellectual property rights in connection with your use of the Service.

7.3 Feedback

Any feedback, suggestions, or ideas provided by you regarding improvements or modifications to the Service (“Feedback”) are considered non-confidential and non-proprietary. You hereby assign all rights in such Feedback to MedTrainer, which may freely use, modify, and incorporate such Feedback into its Service without any obligation to you.

8. AI Usage and Limitations

  • Assistance, Not Replacement: The AI system aids in document categorization but is not a substitute for human review. Users must verify the accuracy of the categorization.
  • No Guarantees: We do not guarantee the accuracy, completeness, or reliability of the AI-generated categorizations. Critical documentation should always be reviewed manually.
  • Potential Misclassifications: In cases of AI misinterpretation or misclassification, users are advised to promptly review and manually correct any errors.

Our platform may incorporate Artificial Intelligence (AI) technologies to enhance the user experience by providing automated solutions, and improved service efficiency. By using our services, you acknowledge and agree to the following:

  • The AI features are designed to assist and support users, not to replace professional judgment or decision-making in critical areas.
  • While we strive to ensure the accuracy of AI-generated results, we do not guarantee their correctness, completeness, or reliability. Users are advised to verify information and caution when relying on AI outputs independently.
  • We disclaim liability for any damages, losses, or adverse outcomes resulting from reliance on AI features. The use of AI is provided “as-is” without warranties of any kind.
  • We may use data collected through your interactions with our services to train and improve MedTrainer AI models.
  • Our AI technologies comply with applicable laws and regulations, including those related to data protection, transparency, and ethical AI use.
  • We do not use or train on any of your data shared through this platform to develop or improve AI models.
